1. Who can use SYNTH Radio
- You must be at least 13 years old to create an account.
- You must be at least 18 (or the age of majority where you live) to buy a subscription or license, to upload songs as a creator, or to receive payouts.
- If you use SYNTH Radio for a business, you confirm you're allowed to accept these Terms on its behalf, and "you" includes that business.
- You may not use the Service if you're barred from doing so by law, or if we've previously banned you.
2. Your account
You sign in with a one-time link sent to your email address. Keep access to that email secure: anyone who can read it can sign in as you. Give accurate information when you set up your profile, keep it up to date, and use one account per person. You're responsible for what happens under your account. Tell us right away at support@synthradio.app if you think someone else has accessed it.
Your username, display name, bio, avatar, artist ("SYNTH persona") profiles and public playlists are visible to other signed-in users.
3. Plans and what they include
- Free: genre radio with short SYNTH Radio announcements between songs, shuffle-only play on artist pages and playlists, standard audio quality, a limited number of skips per hour, and one playlist of up to 10 songs.
- SYNTH Radio X ($4.99/month): no announcements, unlimited skips and playlists, high-quality audio and on-demand play. For personal, non-commercial listening only.
- Pro ($19.99/month): everything in X, plus the ability to buy licenses to use songs in your business (see section 7).
Streaming on any plan is for personal listening inside the Service. It doesn't give you the right to download, copy, broadcast or play songs publicly, for example in a shop or venue. That requires a license (section 7). We may change, add or remove features. If we make a change that significantly reduces a paid plan, we'll tell you in advance, and you can cancel.
4. Subscriptions, billing and cancellation
- Paid plans are billed monthly in advance and renew automatically until you cancel. Payments are processed by our payment provider, Stripe. We don't store your full card details.
- You can cancel at any time in Settings → Manage billing. Cancellation takes effect at the end of the current billing period, and you keep your plan until then.
- Except where the law requires otherwise, payments are non-refundable, including for partial months and unused features.
- If you switch plans, Stripe adjusts the charge for the rest of the current period (proration). If a payment fails, we may retry it and may move your account to the Free plan if it stays unpaid.
- We may change prices. We'll tell you at least 30 days before a new price applies to your subscription, and you can cancel before then. Prices may not include taxes, which are added where required.
5. Uploading songs (creators)
Creators can make SYNTH personas (AI artist profiles) and upload songs under them. When you upload a song, you promise that:
- you hold all the rights needed to upload it and to let SYNTH Radio stream and license it, including any rights required by the terms of the AI tool you used to make it;
- it doesn't copy or sample anyone else's work without permission, and doesn't imitate a real artist's voice, name or likeness in a way that could mislead people or infringe their rights;
- the information you give about it (title, artist, genre, AI tool) is accurate.
You keep ownership of what you upload. You give SYNTH Radio a worldwide, non-exclusive, royalty-free license to host, store, copy, convert (for example, into streaming formats), stream, display and promote your songs, personas and artwork in order to run and market the Service. This license ends when you delete the content or your account, except for (a) copies kept for a reasonable time in backups, (b) content that others have already saved in their playlists, which simply stops playing, and (c) licenses already sold to businesses, which continue under the License Terms.
If you mark a song as licensable, you also authorize SYNTH Radio to sell licenses for it to Pro businesses on your behalf, under the License Terms and at the price you set.
6. About AI-generated music
Every song on SYNTH Radio is made with AI tools. Laws about who owns AI-generated works, and whether they can be protected by copyright, are still developing and differ between countries. SYNTH Radio does not check or guarantee who owns a song, whether it's protected by copyright, or whether it resembles other works. Creators are responsible for their uploads, and buyers should read the License Terms carefully.
7. Licenses and creator payouts
- Pro members can buy a one-time, per-song license for a chosen type of use. Each license is governed by the License Terms and the certificate issued with it.
- The creator receives 70% of the license price (before any tax), and SYNTH Radio keeps 30%. Payments to creators are made through Stripe Connect. To receive them, creators must complete Stripe's onboarding and agree to the Stripe Connected Account Agreement. Payout timing is set by Stripe.
- Creators are responsible for reporting and paying their own taxes on their earnings. Stripe may ask creators for tax information and send them tax forms.
- If a license payment is refunded, reversed or disputed, the license ends, the buyer loses access to the master download, and the creator's share is reversed.
8. Rules for using the Service
You agree not to:
- download, record, rip or redistribute streams, or get around plan limits, ads or other restrictions;
- inflate play counts, followers or rankings artificially, for example with bots or fake accounts;
- upload content that is illegal, hateful, harassing, sexually explicit, violent, deceptive or that infringes someone else's rights;
- impersonate a real person or artist, or mislead people about who made a song;
- scrape the Service, overload it, probe it for vulnerabilities, or spread malware;
- use the Service to break the law or to help anyone else break these rules.
9. Reports, moderation and copyright complaints
You can report a song or artist profile with the Report link on its page. We review reports and may remove content, or suspend or close accounts, that we believe break these Terms or the law, with or without notice. Removed content stays visible to its creator, and licenses already sold remain valid.
Copyright owners: if you believe content on SYNTH Radio infringes your copyright, send a notice to support@synthradio.app including: your contact details; the work you believe is infringed; the link to the content on SYNTH Radio; a statement that you believe in good faith that the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for the owner; and your physical or electronic signature. Creators whose content is removed can send a counter-notice to the same address. We close the accounts of repeat infringers.
10. Closing your account
You can stop using the Service at any time. To delete your account, cancel any subscription and contact us at support@synthradio.app. We may suspend or close your account if you break these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive (for example, licenses already granted, payment obligations, disclaimers and limits of liability) continue after your account closes.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, SYNTH Radio disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the Service will always be available or error-free, or that content uploaded by creators is accurate, lawful or free of third-party rights.
12. Limitation of liability
To the fullest extent the law allows, SYNTH Radio will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, and (b) US $100. Some places don't allow these limits, so they may not fully apply to you.
13. Indemnity
If you upload content or use the Service in a way that breaks these Terms or someone else's rights, you agree to cover SYNTH Radio's reasonable costs, including legal fees, arising from any resulting claim.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in New York, and you and SYNTH Radio consent to their jurisdiction. Nothing here takes away consumer rights that the law where you live gives you and that can't be waived.
15. Changes to these Terms
We may update these Terms. If a change is significant, we'll tell you, for example by email or a notice in the app, before it takes effect. If you keep using the Service after that, you accept the new Terms.
